Terms of service

These terms govern the use of Lumix POS, Lumix Solutions' service for restaurants. By creating an account or using the service, the business accepts them.
The service
Lumix POS is a cloud system for restaurants used from the browser: floor and orders, kitchen display, QR menu, payments and register, electronic invoicing, accounting, purchasing, inventory and payroll. Features may improve or change over time; if we remove something important, we will tell you in advance.
Your account and your users
- The business creates and manages its users, their roles and PINs, and is responsible for what they do in its account.
- Each user must keep their password and PIN safe and not share them.
- If you suspect unauthorized access, tell us right away.
Your tax data and your Hacienda credentials
- The business is responsible for the information it enters: prices, taxes, VAT rates, and customer, employee and supplier data.
- The business sets up its Hacienda credentials and cryptographic key, and authorizes Lumix POS to use them to sign and send its electronic documents.
- Tax returns, such as the D-104, and payroll and social security calculations must be reviewed by the business or its accountant before filing. Lumix POS is a tool: it does not provide accounting, tax or legal advice.
Acceptable use
The service may not be used for illegal activities, to try to access other businesses' data, to interfere with its operation, or to copy or resell it without permission.
Availability
We make our best effort to keep the service available and working well, but we do not guarantee a service level. There may be maintenance and outages, including in services we do not control, such as the internet, Hacienda, printers or browsers. Offline mode lets you keep taking orders and charging quick sales, and anything pending is sent when the connection returns.
Payment
The service is paid according to the plan agreed with Lumix Solutions. If a payment is late, we may suspend access after notifying you, without deleting your data during the suspension.
Intellectual property
Lumix POS, its software, design and brand belong to Lumix Solutions. Your data is yours: we only use it to provide the service, as the privacy notice explains.
Limitation of liability
To the extent the law allows, Lumix Solutions is not liable for indirect damages, such as lost sales or profits, or for errors caused by the business's incorrect data or settings. Our total liability is limited to the amount paid for the service in the three months before the event that gives rise to it.
Termination and data export
The business can stop using the service at any time. We may end it if these terms are breached or payment stops, after notice. When it ends, the business has 30 days to export its information; we then delete it, except what the law requires us to keep.
Changes to these terms
If we change these terms, we will publish the new version here with its date and give businesses advance notice when the change is significant.
Governing law
These terms are governed by the laws of the Republic of Costa Rica, and any dispute will be resolved before its courts.
